ICYMI: Congressional Hispanic Caucus Calls on U.S. Commission on Civil Rights to Investigate Warrantless Immigration Stops
Washington, D.C. – The CHC submitted a formal letter urging an immediate investigation into the impacts of the Supreme Court’s decision in Noem v. Vasquez Perdomo on Latinos. The high court’s ruling allows federal agents to continue their practice of warrantless stops and detention of individuals simply based on factors like apparent ethnicity, language, or occupation.
On Friday, CHC staff presented the formal letter during their testimony before the U.S. Commission on Civil Rights. They warned that this ruling undermines Fourth Amendment protections, invites racial profiling, and puts millions of Latino residents at risk of unlawful enforcement.
“This ruling sets a deeply troubling precedent,” said CHC Chair Rep. Adriano Espaillat. “Latino communities should not be subjected to arbitrary stops based on how they look or sound. The U.S. Commission on Civil Rights must act swiftly to assess the damage and safeguard our hard-fought rights.”
The CHC calls on the Commission to:
- Investigate the ruling’s impact on Latino communities
- Gather testimony from affected individuals and community leaders
- Issue a public report with recommendations for federal and legislative action
- Recommend congressional oversight to prevent misuse or expansion of the decision
Civil rights organizations, including the ACLU, Latino Victory Fund, and LatinoJustice, echoed these concerns, warning the decision encourages racial profiling and rolls back decades of legal progress.
The letter was signed by CHC Chair Rep. Adriano Espaillat (NY-13), Whip Rep. Sylvia R. Garcia (TX-29), Vice Chair of Diversity, Equity, and Inclusion Joaquin Castro (TX-20), and Freshman Representative Gilbert R. Cisneros, Jr. (CA-31).

ICYMI: El Caucus Hispano del Congreso pide a la Comisión de Derechos Civiles de EE. UU. que investigue detenciones migratorias sin orden judicial
Washington, D.C. – El CHC presentó una carta formal instando a una investigación inmediata sobre los impactos de la decisión de la Corte Suprema en Noem v. Vasquez Perdomo sobre los latinos. El fallo del máximo tribunal permite que los agentes federales continúen con la práctica de realizar detenciones sin orden judicial basadas únicamente en factores como la etnia aparente, el idioma o la ocupación.
El viernes, el personal del CHC entregó la carta formal durante su testimonio ante la Comisión de Derechos Civiles de EE. UU. Advirtieron que este fallo debilita las protecciones de la Cuarta Enmienda, fomenta el perfilamiento racial y pone en riesgo a millones de residentes latinos frente a una aplicación de la ley ilegal.
“Este fallo establece un precedente profundamente preocupante”, dijo el presidente del CHC, el Rep. Adriano Espaillat. “Las comunidades latinas no deberían estar sujetas a detenciones arbitrarias basadas en su apariencia o acento. La Comisión de Derechos Civiles de EE. UU. debe actuar con rapidez para evaluar el daño y proteger los derechos por los que tanto hemos luchado.”
El CHC pide a la Comisión que:
- Investigue el impacto del fallo en las comunidades latinas
- Recoja testimonios de personas afectadas y líderes comunitarios
- Publique un informe público con recomendaciones para acciones federales y legislativas
- Recomiende supervisión del Congreso para evitar el mal uso o la expansión de la decisión
Organizaciones de derechos civiles, incluyendo la ACLU, Latino Victory Fund y LatinoJustice, expresaron las mismas preocupaciones, advirtiendo que la decisión fomenta el perfilamiento racial y revierte décadas de avances legales.
