Chairman Espaillat Condemns Secretary Noem's Attempt to Block Congressional Oversight of Immigration Detention
Washington, D.C. -- Congressional Hispanic Caucus (CHC) Chairman Rep. Adriano Espaillat (NY-13) released the following statement condemning the illegal guidance released by Immigration and Customs Enforcement (ICE) on Wednesday, attempting to block congressional oversight of immigration detention facilities.
“Secretary Noem's clumsy attempt to circumvent the law will fail. As the law clearly states, no federal funds ‘may be used to prevent [members of Congress] from entering, for the purpose of conducting oversight, any facility operated by or for the Department of Homeland Security used to detain or otherwise house aliens.’ It could not be clearer – our oversight efforts are well within the law and more necessary today than ever,” said Chair Espaillat.
“In any rational interpretation, the law gives us access not only to detention centers, but to any immigration enforcement facility housing detainees – no matter what ICE chooses to call the facility. The law is also clear that we don't need to provide advance notice, and that it is plainly illegal for ICE to conduct the last-minute cleanups it has been conducting when we have chosen to provide such notice. The Department of Homeland Security under Noem is out of control and we will exercise our oversight functions proactively.”

El Presidente Espaillat rechaza el intento de la Secretaria Noem para prevenir la supervisión congresional del sistema de detención migratoria
Washington, D.C. – El Presidente del Caucus Hispano del Congreso (CHC por sus siglas en inglés), el Rep. Adriano Espaillat (NY-13) emitió el siguiente comunicado en condena de la regulación ilícita publicada por Immigration and Customs Enforcement (ICE) este miércoles, intentando prevenir la supervisión congresional de las instalaciones de detención migratoria.
"Fracasará el torpe intento de la Secretaria Noem para sacarle la vuelta a la ley. La ley dice claramente que ningún fondo federal ‘podrá ser usado para prevenir a [miembros del Congreso] la entrada, con el propósito de supervisión, cualquier instalación operado por o para el Departamento de Seguridad Interior utilizada para detener o de cualquier forma hospedar extranjeros.’ No podría ser más claro – nuestros esfuerzos de supervisión están dentro del marco de la ley y son más necesarios hoy que nunca,” dijo el Presidente Espaillat.
"Bajo cualquier interpretación racional, la ley nos da acceso no sólo a los centros de detención pero a cualquier instalación del aparato de aplicación de la ley migratoria en el cual se encuentren personas detenidas – sin importar qué nombre le de ICE a dicha instalación. La ley también marca claramente que no requerimos dar aviso previo, y que es francamente ilegal que ICE lleve a cabo el tipo de limpiezas de último minuto que ha ejecutado cuando hemos escogido dar tal aviso. El Departamento de Seguridad Interior bajo Noem está fuera de control y nosotros seguiremos ejecutando nuestras funciones de supervisión de manera proactiva.”
