Statement from the Congressional Hispanic Caucus the End of Title 42

WASHINGTON, D.C. - Today, the Congressional Hispanic Caucus (CHC) released the following statement on the end of Title 42 and the new rule which will go into immediate effect to manage regional migration.

“Today marks the end of the Trump-era policy that dehumanized migrants who fled violence, persecution, and natural disasters in their home countries only to be immediately turned away without due process back to the dangerous conditions they were escaping. Under Title 42, most migrants were stripped of their legal right to present a case for asylum. With the end of Title 42, migrants will again have the opportunity to seek a legal pathway for protection through a more humane asylum process.

“We commend the Biden Administration for ending this horrific Trump-era policy and taking necessary action to ensure a return to a policy that will expand the legal pathways for asylum seekers and other migrants, and redirect resources to foster a far more humane and orderly system.

“However, we remain very concerned that the reimplementation of Title 8 will lead to unnecessary harm, lack of due process, and significant negative consequences for too many migrants with legitimate claims of asylum. Healing the harm caused by Title 42 begins with strong investments and increased aid to borderland communities and other localities, and the expediting of work authorizations for asylum seekers so that they can begin contributing to our economy.

“Immigrants are the soul of this country. Past, present, and future generations of immigrants have left and will continue to leave an invaluable legacy on our economy and culture. We have always been a nation of immigrants, and we must continue to fight to protect our migrant populations.”
